Any location that Eastside Safety Ltd is providing services or training at is considered to be a work site. Under the Saskatchewan Occupational Health and Safety Act, it is prohibited to allow, tolerate or participate in the harassment of a person. The definition of harassment in the Occupational Health and Safety Act is:
“harassment” means any inappropriate conduct, comment, display,
action or gesture by a person:
(i) that either:
(A) is based on race, creed, religion, colour, sex, sexual orientation, marital status, family status, disability, physical size or weight, age, nationality, ancestry or place of origin; or
(B) subject to subsections (3) and (4), adversely affects the worker’s psychological or physical well-being and that the person knows or ought reasonably to know would cause a worker to be humiliated or intimidated; and
(ii) that constitutes a threat to the health or safety of the worker;
In addition to this definition, Eastside Safety Ltd further defines harassment as an activity that makes a person uncomfortable through objectionable materials, jokes or humor, or the bullying of any person. Comments or jokes that are delivered by any person in the training environment may appear to be harmless, but will be considered harassment if they make any person uncomfortable. Comments and jokes may also indicate an underlying attempt at subtle harassment, discrimination or ignorance of the truth. Comments and jokes may appear to be harmless, but may be very disturbing and discriminatory to some people. At no time, will Eastside Safety Ltd employees or contractors participate in harassment. Nor will they allow any activity of this type to take place in the workplace they are at.
Differences of opinion, based upon intellectual discussion and presentation of factual materials is not considered harassment, unless the material is presented in such a manner that it violates the definition provided by Saskatchewan OHS and the additional definition held by Eastside Safety Ltd. All people have the right to express their opinion, knowledge and facts in a respectful, non-threatening learning environment.
In the case of providing training at a work site with established Harassment Policies, those policies will be utilized for dealing with a complaint. Where no policies exist at a work site, Eastside Safety Ltd policies will be followed.
Eastside Safety Ltd has created policies regarding harassment in the workplace. These policies are available to any person affected by this statement for their review. If any person feels that they have been harassed, they may file a complaint with Eastside Safety Ltd Privacy Officer at privacyofficer@eastsidesafety.com. Additionally, the option of filing a complaint with the Occupational Health and Safety Division for investigation of the allegation is available.
Eastside Safety Ltd also works within the Manitoba, Alberta and Federal jurisdictions of Occupational Health and Safety legislation. Specific references to those jurisdictions are made in the Eastside Safety Ltd Policy Manual.
Eastside Safety is bound by the Canadian Personal Information Protection and Electronic Documents Act. Whenever personal information is collected, used, disclosed and retained by Eastside Safety Ltd, it will be used only in its course of commercial activities allowed by legislation. The personal information that Eastside Safety collects, uses, discloses and retains for Regulatory purposes does not require consent.
